Devastating news has just come in for Kelly Rutherford – she has officially lost her bid to fight for custody of her two children in the state of California.

A judge in Monaco – where her ex Daniel Giersch and kids Hermes, 8, and daughter Helena, 6 – are currently residing, had already given him full custody of the children.

“We are extremely disappointed with the Ruling,” her attorney told Us Weekly. “Although the Court agreed with our analysis of the law, and in fact agreed with our position that citizens can have more than [one] residence for jurisdictional purposes, the Court ultimately did not agree with us on the facts.”

Daniel and Kelly have been in a custody battle for six years and in 2013, it was determined by the courts that he would no longer have to fly the kids from Monaco to the States to visit their mom. Currently, Hermes and Helena are in New York City with their mom for the summer.

Kelly was originally granted sole custody of the children back in May.

The former Gossip Girl actress’ kids have been living in Monaco with their father Daniel Girsch since 2012, when a judge allowed him to take them out of the country as he was not allowed in the United States.

Kelly was granted sole custody of their two children – Hermes, 8, and Helena, 6 – last month, but then the custody order was blocked by a judge in Monaco.

The summertime visits have happened for the last two years, as spelled out in a custody order issued in Los Angeles back in 2013. Kelly‘s lawyers are afraid there might be problems getting the children back to the states as her ex-husband has been blocking her from seeing the kids since March.

“I can’t imagine that the children won’t be permitted to come to the United States as they’ve done for the past two summers,” Kelly said in a statement after the hearing on Thursday (June 11). “But, so far, their father has not kept up his side of the deal, and I am concerned that he will try to further prevent me from spending time with them.”

“I hope this is finally coming to an end, and my children will soon be coming home,” she added.

After achieving a major victory and being granted temporary sole custody of their kids – Hermes, 8, and Helena, almost 6, – a new judge has blocked the order.

Daniel‘s legal team filed documents that showed a Monaco court now has jurisdiction over the couple’s children and that Kelly withheld crucial information from the California judge. The judge in California and the judge in Monaco will now speak on June 11 in a conference call to work out the details in this case.

The two children have been living in Monaco with their father since 2012, when a judge gave him custody as he would not able to enter the United States to visit the kids. Kelly argued that he could have filed for a visa, but did not.

Kelly Rutherford has finally earned a major victory in her long legal battle for the custody of her children.

The 46-year-old former Gossip Girl actress has been granted sole legal and physical custody of her two kids – Hermes, 8, and Helena, almost 6.

A California judge has ordered that the kids are brought back to the United States from Monaco. They have been living with their father Daniel Giersch in Europe since 2012 after a judge had ruled that he would get custody due to his U.S. visa being revoked. The judge had said at the time that Kelly was able to visit the children in Europe, even though her ex-husband never made an attempt to renew his visa.

The happy news for Kelly comes just days after she reportedly tried to visit the kids in France on Thursday (May 21), but was turned away by Daniel unless she gave their U.S. passports to someone from his team.
